21.01.2022

Before filing a trademark for registration, it is extremely important to conduct a preliminary search for identity and similarity .

A preliminary search will show already registered trademarks, international trademark registrations that are protected in the Republic of Kazakhstan, as well as those trademarks that are in the process of registration.

A preliminary search is carried out at the National Institute of Intellectual Property (NIIP). In the normal mode, NIIS conducts this work within one month, in an accelerated mode - two weeks. Preliminary search is a paid procedure. Preliminary search for trademarks is extremely important. If you submit a trademark for registration without a preliminary search, you may end up with such a situation that such a trademark may have already been registered. That is, in this case, money and time were wasted. If a preliminary search shows that such a trademark has already been registered, that is, it is confusingly similar to it, then another trademark must be created.

After conducting a preliminary search, the trademark registration process should begin, which will take about one year. In the application for registration of a trademark, it will be necessary to indicate information about the applicant, which includes the full name, legal address, a copy of the certificate of state registration or certificate of registration received on the e-government portal egov.kz. The trademark submitted for registration must be presented in fifteen reproductions of the designation 8x8 cm in the color combination in which the registration takes place.

It is also necessary, in accordance with the International Classification of Goods and Services (ICGS), to submit a list of goods produced and services provided. Without performing all the indicated actions, it is impossible to start and maintain a trademark registration. Along with the preparation of the above documents, you must pay a state fee. After payment of the state fee, a receipt of payment must be attached to the application for registration of a trademark in Kazakhstan. The size of the duty is decisively influenced by the number of classes for supplied goods and services in accordance with the International Classification of Goods and Services (ICGS). Naturally , the greater the number of classes , the greater the amount of the fee . After preparing the designated documents and paying the fee, the forms must be submitted to the National Institute of Intellectual Property (NIIP). You can also submit an electronic application for registration of a trademark in Kazakhstan.
